Dear Ms. Fafard:
We are the attorneys for Smokehouse Pet Products, Inc.
Our client has forwarded to us a copy of your published and circulated email addressed to “To Whom It May Concern.” Transmitted herewith is a copy of your email, so that we may make proper reference to it.
First and foremost, our client has had its products repeatedly tested by independent laboratories which have confirmed that there are no contaminants, melamine, or other toxic or poisonous matters. Separately, independent governmental agencies have undertaken tests and have confirmed the foregoing. Specifically, 3 weeks of scientific feeding tests were done monitoring 15 dogs for 3 weeks; the product was not found to be harmful to the dogs.
Although our client is distressed that your dear pet suffered illness, our client disclaims any liability or responsibility therefor.
Your concern for the well-being of your pet may be genuine, nevertheless, such concern does not grant to you the license, privilege or right to disseminate false, libelous, untruthful and defamatory statements.
You are hereby advised that you must immediately cease and desist from publishing, republishing, circulating, uttering or disseminating the above-mentioned email, or any other communication containing such legally actionable language. If you fail to cease and desist, our client will be constrained to take appropriate action against you, including, but not limited to, seeking a restraining order, as well as seeking damages or defamation, trade liable, and intentional interference with contractual arrangements.
Being a “heartbroken puppy owner” does not grant you immunity from the consequences of wrongful utterances, inaccurate statements, and libelous, defamatory and trade slander activities. We urge you to seek legal counsel and advice in order that you can be further apprized and informed of your legal exposure, and we trust that you will not continue this type of conduct, especially in light of the extreme damages which may be chargeable to you after being put on due notice of all of the foregoing.
